Annulment QUESTION from Patricia Miller May 28, 2001 Is the use of contraceptives by non-Catholic marriage partners sufficient grounds for the Catholic Church to declare the marriage null?
ANSWER by John-Paul Ignatius, OLSM on July 8, 2001 Dear Miss Miller:
You will need to ask your Marriage Tribunal in your diocese to be sure on an answer to this. My understanding of canon law on marriage the mere use of contraceptives would not be sufficient all by itself to warrant an anulment, but if the partner did not intend to have children at all, that would make the marriage invalid.
More in likely a fuller picture of the marriage, that includes the issue of the contraception amongst all the rest of the story of the marriage, may lead to an anullment.
But you need to check with your diocesan authorities.
